３．許可申請の必要な場合 When permission application is necessary

１．外国からコックを呼びたいとき Invitation of the cook
コックさんは、日本のレストランから招へいされて日本に来ることが一般的です。この場合、日本のレストランの責任者が、コックさんのために「技能」の在留資格認定証明書の交付申請をすることになります。
もちろん、短期滞在で来日し、自分で自分を招へいする手続をすることもできます。
It is common a cook is invited by a restaurant of Japan, and to come to Japan. In this case the person in charge of the restaurant of Japan will do the grant application of the residence status authorization certificate of "the skill" for a cook.
Of course you visit Japan by a short stay and can do a procedure to invite yourself by yourself.

２．在留期間を更新したいとき Extension of the residence period
コックさんが「技能」の在留資格で滞在できる期間は、３年または１年と定められています。この期間を超えて在留するためには、在留期間の更新の手続が必要となります。
オーバーステイになってしまうと、退去強制の対象となるだけでなく、刑事罰の対象ともなります。

３．日本へ家族を呼びたいとき Invitation of the family

４．他のレストランへ転職したいとき

コックさんが今働いているレストランから他のレストランへ転職することは自由にできます。このとき、就労資格証明書は必ずしも必要なものではありませんが、就労資格証明書をもっていると転職がスムーズにできます。

５．自分のお店をもって独立したいとき
When you become independent
コックさんが独立して自分の店を持つときは、個人開業と会社設立との２つの方法があります。外国人の場合は、会社を設立することがよいでしょう。その理由は、「投資・経営」の在留資格を取得するのに有利であることと、日本での信用を得やすいことです。
したがって、会社の設立と、「投資・経営」の在留資格の認定申請と、飲食店営業許可申請などが必要となります。

The first reason is the thing that is advantageous though you acquire a residence status of "Investment, Business manager". As for the second reason, you are easy to get trust in Japan.
